Scope<\/h4>\r\n<p>These General Terms and Conditions of Use apply to all use of the Application and to all orders for products or services (including the CVA) provided by Grand Cercle through the Application. They are supplemented by the privacy policy below, which describes in detail how Grand Cercle processes Users&#039; personal data.<\/p>\r\n\r\n<h4>5. Accessing and Using the Application<\/h4>\r\n<p><strong>5.1. Conditions of access<\/strong><\/p>\r\n<ul>\r\n  <li>The application is available free of charge on app download platforms compatible with your device (Google Play Store, Apple App Store, etc.). Any connection costs (internet, mobile data) remain your responsibility.<\/li>\r\n  <li>Some features are reserved for Users who have created a User Account (e.g., purchase of CVA, access to &quot;back office&quot; features, affiliation with a school or entity).<\/li>\r\n<\/ul>\r\n<p><strong>5.2. Creating a User Account<\/strong><\/p>\r\n<ul>\r\n  <li>To create an Account, the User must provide an email address and choose a password, as well as their first and last name.<\/li>\r\n  <li>The information provided must be accurate, up-to-date, and truthful. Grand Cercle reserves the right to suspend or delete any account that fails to comply with this requirement.<\/li>\r\n  <li>The User Account is strictly personal and cannot be shared with third parties.<\/li>\r\n<\/ul>\r\n\r\n<h4>6. Main Features<\/h4>\r\n<p><strong>6.1. CVA Management<\/strong><\/p>\r\n<ul>\r\n  <li>The CVA is strictly personal and cannot be assigned or transferred to a third party, under penalty of cancellation of the CVA by Grand Cercle.<\/li>\r\n  <li>The CVA is offered for sale via the Application or other sales channels of the Grand Cercle.<\/li>\r\n  <li>When purchasing a CVA, the necessary data (name, surname, email, school, etc.) are collected for the management and verification of the validity of the card.<\/li>\r\n<\/ul>\r\n<p><strong>6.2. Affiliations and proof of membership<\/strong><\/p>\r\n<ul>\r\n  <li>The Application allows Users to request affiliation with an entity (school, association, partner, etc.), providing supporting documents where applicable (student card, school certificate, etc.).<\/li>\r\n  <li>The Student Unions (BDE) and the Grand Cercle validate or reject affiliation requests by consulting the documents provided.<\/li>\r\n  <li>Roles and positions (e.g., President, Treasurer) within an entity are also recorded for internal management of the Application.<\/li>\r\n<\/ul>\r\n<p><strong>6.3. Offer and Event Management<\/strong><\/p>\r\n<ul>\r\n  <li>The listed entities (associations, partners, etc.) can manage their offers, events and members via a dedicated space in the Application (&quot;back office&quot;).<\/li>\r\n  <li>Users with a CVA can benefit from preferential rates or advantages, subject to validation of their affiliation by the relevant entities.<\/li>\r\n<\/ul>\r\n\r\n<h4>7. CVA Sales Conditions<\/h4>\r\n<p><strong>7.1. Price and payment<\/strong><\/p>\r\n<ul>\r\n  <li>The price of the CVA is indicated in euros (EUR), including all taxes, at the time of purchase.<\/li>\r\n  <li>Payment is made via available payment methods (credit card, online payment solution). Grand Cercle does not store payment details.<\/li>\r\n  <li>Grand Cercle reserves the right to modify the price of the CVA at any time, without retroactive effect for purchases already paid for.<\/li>\r\n<\/ul>\r\n<p><strong>7.2. CVA Delivery<\/strong><\/p>\r\n<ul>\r\n  <li>The CVA is dematerialized within the Application.<\/li>\r\n  <li>After payment validation and verification of your status (if applicable), the CVA becomes accessible in your User Account.<\/li>\r\n<\/ul>\r\n<p><strong>7.3. Right of withdrawal<\/strong><\/p>\r\n<ul>\r\n  <li>In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period.<\/li>\r\n  <li>However, if you believe you have a legitimate reason, you can contact our customer service at <a href=\"mailto:webmaster@grandcercle.org\">webmaster@grandcercle.org<\/a> in order to review your request.<\/li>\r\n<\/ul>\r\n\r\n<h4>8. User Obligations and Responsibilities<\/h4>\r\n<ul>\r\n  <li>The User agrees to comply with applicable laws and regulations and not to use the Application for unlawful, fraudulent or public order purposes.<\/li>\r\n  <li>The User agrees not to upload any illegal, violent, defamatory, pornographic, racially hateful, or infringing content.<\/li>\r\n  <li>The User is responsible for maintaining the confidentiality of their login credentials (email address, password) and for any use that may be made of them. In case of theft or loss, they must notify Grand Cercle immediately.<\/li>\r\n  <li>Any use of the CVA by a third party or any attempt to use the CVA for illegitimate purposes exposes the User to cancellation of the card, without refund, and to possible legal action.<\/li>\r\n<\/ul>\r\n\r\n<h4>9. Liability and Warranty<\/h4>\r\n<ul>\r\n  <li>Grand Cercle implements reasonable measures to ensure continuous and high-quality access to the Application. However, the availability of the Service may be interrupted for technical reasons (maintenance, updates, etc.).<\/li>\r\n  <li>Grand Cercle cannot be held responsible for indirect, intangible damages, or damages resulting from misuse of the Application by the User.<\/li>\r\n  <li>Grand Cercle does not exercise any prior control over the content published by Users or entities (associations, partners). Therefore, Grand Cercle cannot be held responsible for content that does not originate directly from its services.<\/li>\r\n<\/ul>\r\n\r\n<h4>10. Intellectual Property<\/h4>\r\n<ul>\r\n  <li>The Application, its content, name, and trademark belong to Grand Cercle or are used with permission. Any unauthorized reproduction, distribution, modification, or exploitation is prohibited.<\/li>\r\n  <li>Content uploaded by Users (profile pictures, documents, proof of affiliation, etc.) remains the property of its authors, but the User grants the Grand Cercle a non-exclusive license for use and display on the Application, to the extent necessary for the proper functioning of the Service.<\/li>\r\n<\/ul>\r\n\r\n<h4>11. Personal data<\/h4>\r\n<p>The processing of personal data carried out within the framework of the Application is described in detail in the <a href=\"#confidentialite-app-detail\">application privacy policy<\/a> below. Amendment to the General Terms and Conditions of Sale<\/h4>\r\n<p>Grand Cercle reserves the right to modify these Terms of Use at any time to adapt them to legal or technical developments concerning the Application. Device information and usage data<\/strong><\/p>\r\n<ul>\r\n  <li>Device information: model, operating system version, technical identifiers (device ID, advertising ID, Android ID, IMEI, BSSID, MAC address), and other diagnostic data.<\/li>\r\n  <li>Usage data: information about how you access and use the Service (pages or screens viewed, clicks, events, etc.).<\/li>\r\n<\/ul>\r\n<p><strong>3.5. However, it may be shared with third parties directly involved in providing the requested product or service.<\/p>\r\n\r\n<h4>6. Data retention period<\/h4>\r\n<ul>\r\n  <li>User account (name, surname, email, profile picture): kept as long as you keep your account active.<\/li>\r\n  <li>Affiliations, roles and proof of admission: retained for the duration of your affiliation or as long as necessary to validate your status, then deleted or archived in accordance with our internal policies.<\/li>\r\n  <li>CVA data: retain their validity for the duration of the current CVA, then archived for administrative and legal purposes for the required period.<\/li>\r\n  <li>Logs and usage data: kept for a minimum period, strictly necessary for security purposes or to improve the Service (typically up to 12 months).<\/li>\r\n  <li>Validated deletion requests: the data concerned is deleted or anonymized, unless retention is required by law or contractual obligation.<\/li>\r\n<\/ul>\r\n\r\n<h4>7. Data Security<\/h4>\r\n<p>We protect your personal data through technical and organizational security measures (encryption, access control, etc.). Data is primarily stored via Firebase (Google Cloud) on servers located, among other places, in the &quot;us-central1&quot; zone. We implement measures compliant with GDPR requirements, particularly regarding data transfers outside the EU.<\/p>\r\n\r\n<h4>8. Data transfers outside the European Union<\/h4>\r\n<p>As Firebase (Google Cloud) servers are located partly outside the EU (e.g., &quot;us-central1&quot;), we take care to implement appropriate safeguards (standard contractual clauses of the European Commission, additional security measures, etc.) to ensure an adequate level of protection for your personal data.<\/p>\r\n\r\n<h4>9. Procedure<\/strong> send a request to <a href=\"mailto:webmaster@grandcercle.org\">webmaster@grandcercle.org<\/a> by indicating your CVA number or the email address of your user account, as well as a clear statement of your deletion request.<\/p>\r\n<p><strong>10.2. Deleted Data<\/strong> : account data (name, surname, email, profile picture), CVA number and usage data, affiliation\/role\/supporting documents data (if no longer required), except where otherwise provided by law or contract.<\/p>\r\n<p><strong>10.3. Exceptions<\/strong> Data whose retention is required by law or necessary for the performance of our contractual obligations is kept only for as long as strictly necessary. Deleting data related to a pending order or service (such as the CVA) prevents that order from being fulfilled.<\/p>\r\n\r\n<h4>11.
